Under 18s and the law

i had a comment removed from this site where i said the model who was under 18 was depicted on a bed in lingerie and could as such be determined as illegal

The following act "The Civic Government (Scotland) Act 1982 , Sect, 52-52B", which was changed in 2005 and now states that it's an offence to take indecent photographs of anyone under 18.

There are some provisions for 16 and 17 year olds, but the images taken, created or made must be for the model, and must only be shown to the model.
It is an offence to be in possession of such images, therefore the sensible option would be not to produce images of that kind.

The law states "indecent photographs", there is no mention of nude or otherwise, suffice to say it is open to interpretation in law enforcement and the courts.

Any photography of under 18's must be age appropriate, fashion, casual and portrait etc. Lingerie, maybe but open to interrelation, especially if it could be considered as, provocative or sexy.
Swimwear is probably considered acceptable, but again may be open to interpretation.

Anything, nude, topless or even the grey "implied" levels are not advisable, some glamour would also not be advisable other than a fully clothed classic style.

just be carefull out there even if they are clothed the image may still be illegal
